MULTIPLE GOP STATE PARTIES AND CITIZENS UNITED FILE FEC COMPLAINT AGAINSTKAMALA HARRIS FOR UNPRECEDENTED CAMPAIGN FINANCE VIOLATION – July 24, 2024

BISMARCK, ND – July 24, 2024 – The Republican Party of North Dakota (NDGOP), alongside
Republican parties from at least 13 other U.S. States and Territories, joined a formal complaint
with the Federal Election Commission (FEC) against Kamala Harris, Harris for President
(formerly Biden for President), and Keana Spencer, in her official capacity as Treasurer. The
complaint addresses an unprecedented $96 million violation of federal campaign finance law
and was filed by Citizens United.


The complaint stems from Vice President Kamala Harris’s takeover of President Joe Biden’s
principal campaign committee following his announcement on July 21, 2024, that he would not
seek re-election. Despite not being their party’s official nominees at the time, Harris rebranded
Biden’s campaign committee as “Harris for President” and assumed control of its funds and
assets. This move, the complainants argue, constitutes a violation of 52 U.S.C. § 30116(f),
which limits the contributions a candidate can receive.


“This is plain common sense,” said Chairwoman Sandra Sanford. “Kamala Harris took nearly
$96 million in campaign funds that were donated to Joe Biden for his presidential campaign.
That is against the law and unfair to the donors who believed they were giving to a very different
candidate.”


Neither President Biden nor Vice President Harris were the official Democratic nominees for the
2024 general election when these changes were made. Moreover, Joe Biden has not filed any
paperwork with the FEC to formally withdraw his candidacy for President, further complicating
the legal standing of the campaign funds now under Harris’s control.


Under FEC regulations, a vice-presidential candidate cannot assume control of a presidential
candidate’s campaign committee before they are officially nominated. By seizing control of these
funds, Harris accepted excessive contributions.


The NDGOP joined many other state parties to call on the FEC to investigate this matter and
hold Kamala Harris and her campaign accountable for their violation of federal campaign
finance law.
